Second Doctor Files Lawsuit Against Magee Hospital
Silver Filed Lawsuit Last Month

PITTSBURGH -- Thursday, a second doctor filed a lawsuit against Magee-Womens Hospital claiming it put the health of thousands of women at risk.The suit makes several allegations against Magee, including lack of appropriate policies to prevent mistakes and intimidation employees.Channel 11's Becky Thompson spoke to the doctor who became the second to make the shocking accusations.The lawsuit contains many of the same allegations as a lawsuit filed last month against Magee-Womens Hospital by Dr. Susan Silver.In the lawsuit against Magee-Womens Hospital, the University of Pittsburgh Medical Center and its health system, Dr. Kenneth S. McCarty claimed that in the course of his employment as physician, professor and assistant dean he observed unethical, unlawful and improper medical practices."We tried for four years to get the things that we saw that needed to be corrected, corrected," McCarty said.The suit claimed there was:
A lack of appropriate policies and procedures in quality control leading to patient misidentification and mislabeling of pathology specimens.
A lack of supervision and training of pathology residents.
Intimidation and physical threatening of faculty and residents who raised concerns.
Falsification of hundreds of thousands of Pap smear reports.
Unauthorized use of McCarty's name and electronic signature indicating he had reviewed slides -- he says he did not.
Destruction of diagnostic slides and medical records to conceal liability. He also claimed that the defendants made self-referrals of tumor specimens for unnecessary and inappropriate diagnostic testing to labs to which some or all the defendants had financial interests.McCarty said, "This is sad, very sad. I wish it didn't have to come to this."In an exclusive interview with Channel 11 Wednesday night, Silver, who is no longer employed by Magee, said that over a period of years she had pointed out to Magee hospital administration problems.According to her lawsuit, she alleges by coming forward she was retaliated against and her professional reputation suffered."I'm essentially unemployable," she said.Channel 11 placed calls Thursday to the attorney representing Magee. He has not returned the call.Wednesday night, in response to Silver's lawsuit, Bill Paitragallo said, "Our viewpoint is diametrically opposed."
He went on to call Silver's lawsuit a distortion.
