Lawsuits To Be Filed Monday Over Duquesne Campus Shooting

Two Former Basketball Players Claim Injuries To Prevent Them From NBA Careers

Posted: 10:31 pm EDT June 22, 2008

Two former Duquesne University basketball players will file a lawsuit Monday morning against the University.

The law firm of Wexler Toriseva Wallace LLP will file suit Monday morning IN the United States District Court on behalf of Shawn James and Kojo Mensah, both of whom were shot at a student dance on campus in September 2006.

The lawsuit alleges that James and Mensah's careers were cut short by the shooting, and that their chances of getting drafted in the NBA were diminished because of their injuries.

"That's the real essence of this suit," said attorney Teresa Toriseva, who is representing James and Mensah. "Their NBA hopes were dashed, eliminated."

They are seek damages for their injuries which are alleged to be millions of dollars.

James was shot in the foot and Mensah was shot in the arm and shoulder.

Three other teammates were also shot that night including Stuard Baldonado who filed suit in April of this year. He is also represented by Wexler Toriseva Wallace LLP.

James and Mensah contend that Duquesne had a duty to protect them while they were attending a back to school dance on campus property.

James and Mensah also allege in their complaint that two gun-toting assailants were allowed into the dance where Duquesne undertook to provide security and failed to do so properly.

James and Mensah were leaving the dance when the two suspects opened fire.
