A marine who sued Rep. Jack Murtha for defamation wants a judge to order the Pa. Democrat to testify under oath in the case.

Murtha, when responding to a deadly encounter in Haditha, Iraw claimed U.S. marines were engaged in cold-blooded murder.

Murtha's lawyer claims the lawmaker has immunity because he was acting in his official role when he made the comments to reporters.
