Jimmy Buffett Wants South Side Bar To Shut Down

Posted: 4:33 pm EST February 27, 2009Updated: 6:23 pm EST February 27, 2009

A famous performer is involved in a bar battle with a Pittsburgh establishment.

Jimmy Buffett's famous song coined the phrase "Wasting Away Again In Margaritaville."

Rich Rizzo and his son Brad said they're still in disbelief over the three page letter from Buffett's lawyers concerning their beloved South Side bar and restaurant.

The letter demands the Rizzo’s immediately cease operating because Buffett owns the name by copyright and operates dozens of restaurants called Margaritaville.

Buffett released the song in 1977. Rizzo complains his investment now is at risk.

“I had to take out my 401(k) from where I work and take out the entire money that I had for my retirement and I'm 63 years old,” Rizzo said.

Margaritaville has been a favorite nightspot on the South Side for decades, known for its famous margaritas. Now its name is in jeopardy of disappearing.

“We sell some good food here, nice atmosphere. We have the greatest clientele here. We really do,” Rizzo said.

The Rizzos have hired a lawyer and are hoping to work things out, fully understanding that Buffett's copyright may force them to change the name.

Rizzo told Channel 11 he thinks that Buffett is bullying and beating up on him because Rizzo said he bought the restaurant just last year, and that Margaritaville on the South Side has been there since 1985.

Calls to individuals representing Buffet were not immediately returned.
