Rutherford Faces Indecent Assault Charges

PITTSBURGH -- The Target 11 team has uncovered new details on the assault charges against University of Pittsburgh quarterback Rod Rutherford (pictured below right).
Target 11's Rick Earle obtained a copy of the criminal complaint Tuesday that sheds more light on the charges against Rutherford, specifically the accusation of indecent assault.
According to the criminal complaint filed against Rutherford, the 19-year-old woman claims Rutherford fondled her numerous times in a Station Square parking lot last week.
The woman said she did not consent nor permit him to make contact with her.
The woman also claims Rutherford grabbed her left hand and attempted to pull her through an open car window, striking her face against the top of the vehicle and causing a large bruise.
She said Rutherford then kicked out the vehicle window with his foot. And according to the complaint, broken glass hit the woman, cutting her forehead.
Twenty-four hours after the incident, the woman was treated at Allegheny General Hospital.
The complaint also states that two other women with the 19-year-old girl witnessed the incident.
Rutherford is charged with simple assault, indecent assault and criminal mischief.
Rutherford's attorney, Jim Wymard, has admitted his client hit the window.
He said Rutherford was upset because the woman threw a glass that just missed him.
But he maintains Rutherford never touched the woman.
"At no time did he have indecent contact with her, or for that matter, there was no simple assault. We admit that he broke the window and he's apologized for that," Wymard said.
Rutherford's attorney claims that the woman threw a glass at Rutherford and he's asked police to file charges against the woman.
There's no mention of that in the criminal complaint.
Rutherford's preliminary hearing has been set for Oct. 30 at 8:30 a.m.
