Judge Denies Motion To Dismiss Suit Against Roethlisberger

RENO, Nev. —

A judge has denied a motion to dismiss a civil suit filed by a woman who claims Pittsburgh Steelers quarterback Ben Roethlisberger raped her at a Lake Tahoe resort last summer.

Last month, Channel 11 News obtained the legal document, which was more than 40 pages long, in which Roethlisberger's attorneys asked that the case against him be dismissed.

In the motion, Roethlisberger's lawyers called his accuser, Andrea McNulty, an "admitted sex addict" and alleged that her lawyer made extortionate demands before filing the suit.

Roethlisberger's attorneys also questioned McNulty's mental condition and requested that she undergo a psychiatric evaluation.

According to the motion, "The plaintiff is a disturbed and calculating woman who, together with counsel, fabricated a claim of sexual assault against a 2-time super bowl winning quarterback to save her job and extort a large monetary payoff."

The motion also claims the woman's lawsuit was "deliberately timed to coincide with the opening of NFL training camps, which ensured that the complaint would garner the attention of the national media."

And in laying out Roethlisberger's defense, his attorneys said, "Rather than reporting to anyone that she had been allegedly raped, she told her friends and co-workers a completely different story. She never told her best friend that she had been sexually assaulted."

A lawyer for McNulty asked a judge to sanction the Steelers quarterback's legal team for trying to "bully" and intimidate her into dropping her civil lawsuit.

Cal Dunlap said Roethlisberger's lawyers tried to "smear" the woman with an affidavit from an ex-friend who said the sex at a hotel-casino was consensual and that the woman bragged about it.
