CORTE MADERA, Calif. —
A San Rafael man said he wanted to get caught for driving solo in the carpool lane because he wanted to make a statement.
The man told KTVU he was driving in the carpool lane along Highway 101 in Marin County when a California Highway Patrol officer pulled him over.
He argues that even though he was the only person the officer saw in the car, he wasn't alone.
Jonathan Frieman said he's not trying to beat an expensive citation.
He says he deliberately drove in a carpool lane
"I was hunting," Frieman said. "I wanted to get caught."
With only a pile of papers next to him, the documents were part of a corporation he co-founded.
"There's a pile of cars on the freeway," he said. "The carpool lane is open. I have two persons in the car, me and a corporation
The 59-year-old said the California vehicle code's definition of a person includes a corporation.
He contends the paperwork from his corporation is therefore a person.
"We're asking what signifies a corporation," he said. "What's a person."
The self-described activist for the homeless and the environment is scheduled to go before a traffic commissioner Monday afternoon.
He said he hopes he will lose, so he can appeal the decision.
He wants to people to think about the role of corporations and their responsibilities.
One 30-year veteran CHP officer described what happens to most carpool lane violators in court.
"In the majority of cases I've been involved in, the violator has been found at fault," said CHP officer Sam Morgan.
Frieman said what he wants the definition to be stood on its head, but in doing so people will see the absurdity.
