"This has been a traumatic experience for her," said Ken Haber, Martin's criminal attorney. "But it was made more traumatic by the fact she was charged criminally after having been assaulted."

Martin was charged with disorderly conduct and defiant trespass after the incident at Pizza Milano.

In court, the commonwealth called a Zone 2 police officer to the stand, and the officer attested to being called to two previous altercations along Forbes Avenue, which led up to the violent attack.

Channel 11 was able to see two new videos that the district attorney's office was previously unable to show us.

The videos give new vantage points of the altercation, showing then-manager Yilmez trying to block Martin from entering the restaurant.

"It shows Jade was outside as other people were outside on the video, and she attempted to enter the establishment," Haber said. "That's all she tried to do and then she was physically assaulted."

Cellphone video shows Martin walk past the manager, who then slammed her to the ground and repeatedly hit her head on the floor, yelling, "I said, 'Please!'"

"The evidence was presented by the commonwealth here today and the judge dismissed the charges. He did the right thing. She's the victim here. She should have never been a defendant," Haber said

Yilmez is facing criminal charges.

Martin's civil lawsuit is still moving forward.
