Official Rules & Regulations

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. NO SUBMISSION TO A SALES PRESENTATION REQUIRED. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

OVERVIEW: The Terry's Plumbing "Project Warm Home" Promotion ("Promotion") is sponsored by Terry's Plumbing, Heating and Air Conditioning, Inc. and Rheem Manufacturing Company (together, "Sponsors") and administered by WPXI, Inc. ("Administrator"). Entrants will be asked to submit a short essay explaining why they, or someone they know, are in need of a new furnace. Sponsor will then select three winning entries, as detailed below, and a new furnace will be awarded to each winning entrant, or to the person(s) on whose behalf the winning entrant requested a furnace (subject to verification of recipients' eligibility and compliance with these Official Rules).

ELIGIBILITY: Except as otherwise set forth below, there are no restrictions on who may submit an entry in the Promotion. However, to be eligible to win a prize, you, or the person you nominate to receive a prize, must be at least eighteen (18) years of age or older as of the date of your entry, and must own a primary residence in (no rental or vacation properties, secondary residences, or commercial properties will be eligible), and be a legal resident of, one of the following Pennsylvania counties: Allegheny, Beaver, Butler, Fayette, Washington or Westmoreland. Employees of Terry's Plumbing, Heating and Air Conditioning, Inc., Rheem Manufacturing Company, WPXI, Inc., Cox Broadcasting, Inc., the National Broadcasting Company, and each of their respective affiliated companies, subsidiaries, and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, such employees, are not eligible to submit an entry (either or on their own or another's behalf) or to win a prize. For purposes of this Promotion, the term "immediate family members" includes an entrant's spouse, children, siblings, grandparents and grandchildren.

HOW TO ENTER: The Promotion will begin at 12:01 a.m. (E.S.T.) on Monday, January 9, 2006 and end at 11:59 p.m. (E.S.T.) on Monday, February 27, 2006 (the "Promotion Period"). To enter, visit www.WPXI.com or www.Pittsburgh.com and look for the Terry's Plumbing "Project Warm Home" prompt or ad. Click on the prompt or ad to reach the Promotion entry site. Once there, enter your name, address (including city, state and zip), email address, birth date and daytime telephone number (including area code) on the online entry form, and explain, in the space provided, why you, or the person who you are nominating to receive a new furnace (if not submitting an entry on your own behalf), are in need of a new furnace and why you think you, or the person you are nominating, should be selected by Sponsors to receive one of the new furnaces being awarded in the Promotion. Your essay must be 150 words or less. Once you have completed the online entry form, submit your entry by clicking on the "Click Here to Enter" button. You also may enter by sending your essay (as described above, and limited to 150 words or less), along with your name, address (including city, state and zip), birth date and daytime telephone number (including area code) to "Project Warm Home," P.O. Box 1100, Pittsburgh, PA 15230. Limit one (1) entry per outer stamped envelope. Sponsors will select winners in the manner described below on three separate dates (each a "Judging Event") - the first winner will be selected on or about January 30, 2006 from among all eligible entries received as of that date; the second winner will be selected on or about February 15, 2006 from among all eligible entries received as of that date; and the third and final winner will be selected on or about February 27, 2006 from among all eligible entries received as of that date. At each Judging Event, Sponsors will select a winner based on eligible entries received from the start of the Promotion to the applicable date set forth above, and to be eligible for consideration in a particular Judging Event, your entry must be received by the applicable date set forth above. Eligible entries will be carried over from one Judging Event to the next. Entries received after February 27, 2006 will not be eligible for consideration. You may submit multiple entries, but may only submit one (1) entry per nominee (i.e., you may nominate yourself once, and also may submit entries nominating neighbors, friends, etc. but you may not submit multiple entries on behalf of yourself or any other individual). Administrator and/or Sponsors will not be responsible for incomplete, lost, late, postage-due, illegible or misdirected entries, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Administrator. Any questions regarding the number of entries submitted shall be determined by Administrator in its sole discretion, and Administrator reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Promotion. All entries become the property of Administrator and Sponsors and will not be returned.

WINNER SELECTION: Three (3) Grand Prize Winners will be selected in the Promotion. As set forth above, Sponsors will select winners via three separate Judging Events - the first winner will be selected on or about January 30, 2006 from among all eligible entries received as of that date; the second winner will be selected on or about February 15, 2006 from among all eligible entries received as of that date; and the third and final winner will be selected on or about February 27, 2006 from among all eligible entries received as of that date. For each Judging Event, Sponsors and the Promotion judges designated by Sponsors ("Judges") will review the eligible entries received from the start of the Promotion to the applicable date set forth above and will select one (1) winning entry based on persuasiveness of the essay, emotional appeal, and the demonstrated need for a new furnace. Entries will be judged on a relative basis. Decisions of Sponsors and Judges will be final and binding in all respects. The Grand Prize Winner will be the person named in the winning entry as the person who should receive a new furnace (whether the entrant or a person or persons nominated by the entrant).

PRIZE DESCRIPTION: Each Grand Prize Winner will receive a new Rheem 80% Furnace with a minimum estimated retail value of Nineteen Hundred Dollars ($1,900.00) and a maximum retail value of Twenty-five Hundred Dollars ($2,500.00). Prize value will depend on system selection. System selection will be based on a complete "load calculation" evaluation that includes the size, shape, and orientation of each home, the type of insulation in the home, window size, type, quantity and direction, house construction materials, along with seals, vents and ductwork. System selection will be at the sole discretion of Sponsors and their representatives. Sponsors reserve the right to inspect each winner's existing furnace to confirm that it needs to be replaced, and reserve the right to disqualify any winner that Sponsors determine, based on such inspection, is not in need of a new furnace. Prize includes installation of new furnace and removal of old furnace. Prize will only be installed in a primary residence owned by winner (no rental or vacation properties, secondary residences, or commercial properties will be eligible).

WINNER NOTIFICATION AND ACCEPTANCE: Administrator and/or Sponsors will attempt to notify each entrant that has submitted a winning entry (each a "Selected Entrant") by phone (correct daytime phone number, including area code, must be provided in all entry materials), during regular business hours, within seven (7) days following each Judging Event. If a Selected Entrant submitted the winning entry on his or her own behalf, he or she will be declared a Grand Prize Winner (subject to verification of eligibility). If a Selected Entrant nominated someone other than him or herself to receive a prize, the person nominated by the Selected Entrant will be declared a Grand Prize Winner (subject to verification of eligibility) and the Selected Entrant will be asked to provide full contact information for the Grand Prize Winner. If Selected Entrant is unable or unwilling to provide the necessary contact information for the person he or she nominated to receive a prize, the Selected Entrant and his or her nominee may be disqualified. Administrator's and/or Sponsors' inability to reach a Grand Prize Winner for any reason may, at the sole discretion of Administrator and Sponsors, result in that winner's disqualification and the forfeiture of that winner's interest in all prizes, and the Sponsors may select a substitute winning entry from among all remaining eligible entries. Winners may waive their right to receive a prize. Prizes and individual components of prize packages are nonassignable and nontransferable. No substitutions or transfers of prizes by winners are allowed. Prizes and individual components of prize packages are subject to availability and Sponsors reserve the right to substitute prizes of equal or greater value. Each Grand Prize Winner will be required to complete an affidavit of eligibility and a liability and publicity release (except where prohibited by law). Failure to sign and return the affidavit and release, or to comply with any term or condition of these Official Rules, may, at the sole discretion of Administrator, result in a winner's disqualification and the forfeiture of his/her interest in the prize. Any prizes not claimed by eligible winners by March 1, 2006 will remain the property of the Sponsors and will not be awarded. Except where prohibited, acceptance of a prize constitutes each winner's consent to the publication of his/her name, voice, likeness, image, biographical information, and hometown by Administrator and/or Sponsors in any media (including broadcast, print, and other media) for any commercial or promotional purpose without limitation or further compensation.

PARTICIPATION; ERROR/FRAUD/MALFUNCTION: By participating, entrants agree to be bound by these Official Rules and the decisions of the Administrator, Sponsors and the Judges. No more than the advertised number of prizes will be awarded. Sponsors, in their sole discretion, reserve the right to disqualify any person found tampering with the entry process or the operation of the website or otherwise found in violation of these Official Rules. In the event the Promotion is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Administrator, which corrupts or impairs the administration, security, fairness or proper operation of the Promotion, Administrator reserves the right in its sole discretion to suspend, modify or terminate the Promotion. Should the Promotion be terminated prior to the stated expiration date, Administrator and Sponsors reserve the right to award the prizes based on the entries received before the termination date.

GENERAL RELEASE: By entering the Promotion, entrants release Terry's Plumbing, Heating and Air Conditioning, Inc., Rheem Manufacturing Company, WPXI, Inc., Cox Broadcasting, Inc., the National Broadcasting Company, any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Promotion or with the acceptance, possession, use or misuse of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant or winner and Sponsors and/or Administrator, shall be governed by, and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules or provisions (whether of Pennsylvania, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Pennsylvania. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
