(“Sponsor” or “WPXI”). The Contest is open to all practicing high school cheerleading squads in the Western Pennsylvania Interscholastic Athletic League (WPIAL) division. Employees of WPXI, Inc., Cox Broadcasting, Inc., the National Broadcasting Company, and each of their respective affiliated companies, subsidiaries, and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, such employees, are not eligible to participate or to win.AUTHORIZATION/PUBLICITY RELEASE: Each participating cheerleading squad acknowledges and agrees that Sponsor will have the right to edit, adapt, modify, reproduce, publish, promote, broadcast, or otherwise display or use entries on the WPXI.com website and/or on Channel 11 in connection with the Contest without limitation or compensation to any school, squad, or squad member. All entries must be submitted by, or authorized by, the cheerleading squad’s coach/advisor (“Adult Sponsor”), who will be responsible for obtaining the express consent of all participating cheerleaders, and their parents or legal guardians, to submit the video in the Contest and to grant Sponsor the rights granted below. Except where prohibited, participation in the Contest constitutes the consent of each Adult Sponsor and participating cheerleader to Sponsor’s publication of his or her name, biographical information, likeness and image (including without limitation his or her videotaped Cheer) in any media in connection with the Contest. By entering the Contest, each Adult Sponsor and participating cheerleader discharges and releases WPXI, Inc., and its officers, directors, employees and agents, from any and all rights, claims, causes of action or objections that such Adult Sponsor or participating cheerleader may have, or that may subsequently accrue to him or her, as to any use that may be made of his or her name, biographical information, likeness, image or videotaped Cheer performance in connection with the Contest.HOW TO ENTER: The acceptance of Contest entries will begin at 7 p.m. (E.T.) on Sept. 4 2009 and end at 10:00 p.m. (E.T.) on Oct. 30, 2009 (the “Contest Period”).To enter:1. Create a Cheer: To enter the Contest, your cheerleading squad must create an original, fully conceived and choreographed cheer and cheerleading routine. The total running time for each Cheer must not exceed two (2) minutes. Sponsor reserves the right to disqualify any Cheer that exceeds the two (2) minute maximum. Videos may not contain materials that infringe any third-party’s intellectual property rights; do not include copyrighted music or images in your video unless you have permission to do so. Sponsor reserves the right to disqualify any entries that are alleged to infringe any third-party’s intellectual property rights or that Sponsor deems obscene, offensive or otherwise inappropriate for viewing by a general audience.2. Perform Your Cheer at a High School Football “Game of the Week” or Submit Your Cheer Directly to WPXI:At each Game of the Week, the cheerleading squad for each team participating in the game (i.e., the home team’s cheerleading squad and the away team’s cheerleading squad) will have the opportunity to perform their Cheer and have it videotaped by WPXI for entry into the Contest. WPXI will videotape, and post to the WPXI.com website, one (1) Cheer for each scheduled team’s cheerleading squad (totaling two (2) Cheers per game).Direct Submission Process: If your cheerleading squad is not participating in a Game of the Week but would still like to enter the Contest, you can videotape your squad’s performance of its Cheer and submit that video directly to WPXI by mailing the video in DVD format to: Channel 11’s Cheer of the Year Contest, WPXI-TV, 4145 Evergreen Road, Pittsburgh, PA 15214. As noted in Section 1(a), above, the total running time for each Cheer must not exceed two (2) minutes, and Sponsor reserves the right to disqualify any Cheer that exceeds the two (2) minute maximum. Limit one (1) entry per cheerleading squad. All entries submitted directly to WPXI must include the name of the submitting high school and the names of all of the cheerleaders performing in the videotaped Cheer and must be submitted by, and include the name and contact information (mailing address and telephone number) for, the cheerleading squad’s coach/advisor (“Adult Sponsor”). All entries must be received by Sponsor by 10:00 p.m. (E.T.) on Oct. 30, 2009. No entries received by Sponsor after 10:00 p.m. (E.T.) on Oct. 30 will be accepted.Sponsor will not be responsible for incomplete, lost, late, postage-due, or misdirected entries, for corrupted video files, DVDs or CDs, or for files, tapes, DVDs or CDs that are otherwise unplayable or inaudible, or for entries that do not meet the length or formatting requirements specified above, and all such entries may, at Sponsor’s discretion, be disqualified. Sponsor will not be responsible for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. All entries become property of Sponsor and will not be returned.WINNER SELECTION: All eligible Cheers recorded by WPXI at a Game of the Week or submitted directly to WPXI will be posted to the Skylights “Cheer of the Year” section of the WPXI.com website. Beginning at 5 p.m. (E.T.) on Monday, Nov. 2, 2009 and continuing until 5:00 p.m. on Friday, Nov. 20, 2009 (the “Voting Period”) visitors to the WPXI.com website will be prompted to vote for their favorite Cheer. Visitors to the site may vote as often as they like provided that the use of software or other automated processed to submit multiple votes is prohibited and votes submitted by such means will be disregarded. At the end of the Voting Period, the Cheer that has received the highest number of votes will be declared the winner. In the event of a tie, Sponsor will conduct a random drawing from among the tied entries to select one (1) winning Cheer. The winning cheerleading squad will be contacted directly by Sponsor.PRIZE DESCRIPTION: Subject to verification of eligibility and compliance with the terms of these Official Rules, the winning cheerleading squad will receive a Two Hundred And Fifty Dollar ($250) American Express Gift Card and a chance to appear in a future Channel 11/WPXI.com promotional announcement. The American Express Gift Card will be awarded to the squad’s Adult Sponsor, who may waive the squad’s right to receive the prize. The prize is nonassignable and nontransferable.PRIZE CLAIM PROCEDURES: The winner may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) as a condition of receiving prize. Failure to timely sign and return any required affidavit or release or to comply with any term or condition of these Official Rules may result in a winner’s disqualification and the forfeiture of all interest in the prize.
