Pot Charges Dropped Against Steelers WR Holmes
Updated: 3:54 pm EDT June 10, 2009
PITTSBURGH -- The case has been dropped against Pittsburgh Steelers wide receiver and Super Bowl MVP Santonio Holmes, who was arrested on a misdemeanor marijuana charge stemming from a traffic stop in October.Pittsburgh police said they found three marijuana-filled cigars in Holmes' car when he was pulled over Oct. 23 near Mellon Arena. Holmes was stopped because his vehicle was similar to one police were looking for in a drug sting."The tip was anonymous, and the quality of the information in the anonymous tip was such that it was not specific enough to justify the search," said Holmes' attorney Bob Delgrecco.Police said Holmes cooperated and pointed out the drugs to officers.VIDEO: Holmes, Attorney Comment Outside Courtroom
"We've contended all along that this was constitutionally infirm," said Delgrecco. "We're glad we've been able to convince the Commonwealth to essentially dismiss the case without a hearing. So we're delighted."Delgrecco argued that police had no legal right to pull Holmes over and search his car. On those grounds, he anticipated that the evidence in the case would be thrown out.According to Channel 11 reporter Vince Sims, the charges were dropped because the district attorney did not feel that he could justify the search of Holmes' vehicle.Holmes had been facing 30 days probation and a $500 fine if convicted.
