PITTSBURGH -- Channel 11 News has learned Thursday charges will be filed against University of Pittsburgh quarterback Rod Rutherford (pictured, right) for allegedly assaulting a woman.
Police plan to charge Rutherford with one count of simple assault, one count of indecent assault and one count of criminal mischief.
Rutherford will not be arrested. He will be sent a summons in the mail, which could be sent out as soon as Friday.
Pitt coach Walt Harris also took disciplinary action Thursday. Harris did not suspend Rutherford, but he will not start in Saturday's home opener against Kent State. Backup Luke Getsy is in line to get the start.
Harris released this statement about Rutherford Thursday:
"From the information we have, he has engaged in behavior that is contrary to those expectations, our team rules, and the responsibilities he assumes as a leader.
On the basis of the information at hand, I have arrived at a disciplinary decision regarding Rod.
Other than announcing that Rod will not start the first game of his senior year at home, though I do expect him to play, I will not disclose the other disciplinary actions I have taken.
I recognize that the formal legal investigations and procedures continue. We do not manage or control these procedures or the legal system. That will develop on its own timetable."
The move comes five days after Rutherford was accused of assaulting a woman in a parking lot at Station Square.
According to police, when the alleged victim refused Rutherford's advances, he allegedly broke one of the car's windows and assaulted her.
Channel 11 spoke with the alleged victim's aunt and she said, "My niece had no idea who Rod Rutherford was and that her accusations would cause so much publicity."
This is Rutherford's second off-field incident during his career at Pitt.
When he was a red-shirt freshman, he was suspended one game for using unauthorized university phone-access codes.
