His alleged victim was not in court, but she gave her thoughts to Channel 11 after his court appearance.

“I really don’t see how you can refute that you were guilty, especially since it was caught on video,” the woman said.

Caffarelli was arrested on Dec. 17 at the Settlers Ridge shopping center after the woman showed police a cellphone video of the suspect performing a lewd act right in front of her in the restaurant.

“It’s obviously gross to be subjected to that, but my fear is if there had been somebody younger there – a child – you just never know,” said the woman.

On Tuesday, the district attorney agreed to dismiss the open lewdness charge but held two other charges, including indecent exposure, for court.

Caffarelli’s lawyer said his client is deeply sorry for any problems he may have caused.
