Appellate court says UPMC whistleblower lawsuit can proceed

PITTSBURGH — The Third District Court of Appeals upheld the reinstatement of a whistleblower lawsuit against UPMC and several of its neurosurgeons, which was thrown out of court last year.

The lawsuit was filed by three former UPMC employees in 2012 and was dismissed by U.S. District Court for the Western District of Pennsylvania Judge Cathy Bissoon. A three-judge panel of the appellate court ruled that the case had merit and ordered reinstatement in September, which UPMC appealed for a second review.
