Plea deals possibly in works for 2 adults charged in death of boy shot by friend

MOUNT PLEASANT, Pa. — Two adults charged in connection with the March 2016 shooting death of a 13-year-old boy at a Mount Pleasant home were in court Tuesday as the boy’s family awaits justice.

James “J.R.” Gustafson was fatally shot by his then 14-year-old friend, who has since pleaded guilty and was sentenced to a juvenile treatment center until he is 21 years old.

Brooke Nelson was babysitting on the night of the shooting while Joshua Hudec, the owner of the gun, was at work. Investigators said the gun was not secure, found under a mattress.

Nelson and Hudec appeared in court Tuesday, possibly working toward a plea deal -- something some members of the Gustafson family don’t not want.

“I personally would like to go to trial because I think they should live it out and see the pain they caused me and my family, and a plea deal is just signing a piece of paper and that’s it,” Mark Gustafson, J.R.’s father, said.

Hudec’s attorney, William Wiker, said his client should not be held to the same accountability as Nelson.

“He feels terrible about what happened. He wasn't there that night, but this is a terrible event. He is a father and has kids himself. No parent should have to go through this with their child,” Wiker said.
