Family Sues Housing Group In Squirrel Hill Over Awning

PITTSBURGH,None — The parents of an 18-month-old boy have filed a lawsuit in federal court against their neighborhood association in a fight to add a retractable awning to their home.

The child, Jonah Snyder, has glaucoma and Neurofibro Matosis Type 1.

He wears baby glasses and always plays indoors when the sun is shining. Dan and Jaime Synder want to build an awning on their Summerset at Frick Park home, but the neighborhood association said it wouldn't fit the design of the single-family homes and suggested portable umbrellas.

The fight has continued back and forth and on Thursday, the family's lawyer sent Channel 11 a copy of the new federal lawsuit that reads, "The defendant violated the Federal Fair Housing Act by refusing to provide a reasonable accommodation to a minor child with a disability, an equal opportunity to use and enjoy his family's entire residential home."

Channel 11 talked with the association's attorney who said he can't comment on the pending case and said he can't access the case online yet because it was just filed yesterday.

The association told Channel 11's partners at the Tribune Review that they have a right to argue that Jonah is not handicapped under federal law.
