Lawsuit accuses Brentwood police officers of using excessive force during traffic stop

BRENTWOOD, Pa. — A man is suing Brentwood Borough and several police officers after a 2024 traffic stop, demanding a jury trial and more than $50,000.

Channel 11 obtained police body cam video of a Brentwood police officer tasing Devin Irwin after he refused to listen to police commands during a traffic stop. 

It started with officers pulling a car over on Route 51 for an obstructed license plate. Irwin was in the passenger seat of that vehicle.

Video from the police car’s dash cam shows multiple officers at the passenger door, telling Irwin to get out of the car. Irwin repeatedly refuses, which prompts the officers to lift him out of the vehicle and push him to the ground. 

Then, an officer tases Irwin while he is face down on the pavement. 

“Here’s what they maybe should have done. They can pull him out of the car, they can detain him. They have four officers there to handcuff him and put him in a squad car,” Irwin’s attorney, Anthony Giannetti, told Channel 11. 

Giannetti says his client didn’t deserve what they’re calling “excessive force” from the officers. 

“At that point, he’s face down on the ground, and he has four officers on his back. He’s not capable of offering any meaningful resistance at that point. So there’s absolutely no reason to use a taser,” Giannetti said. 

Giannetti added that Irwin never made any threats toward police, which is another reason he’s questioning why Irwin was picked up, pushed to the ground, and tased. 

According to court documents, none of the officers involved have been charged for their role in the arrest. 

Channel 11 asked the Brentwood Police Department for a comment on the lawsuit, but we have not received a response.
