SUMMIT TOWNSHIP, Pa. — The insurance companies for Butler Area School District contend that they won’t be forced to make any payouts in a lawsuit over lead in the water at Summit Elementary School.
, the issue came up during a federal court hearing Tuesday in Pittsburgh.
Lawyers for The Netherlands and Peerless insurance companies are asking a judge to order that they do not have to pay or defend the district or former Superintendent Dale Lumley,

A federal lawsuit contends Lumley and other district administrators concealed information for months about dangerous levels of lead in the water supply at the elementary school.

reported that a lawyer for both companies argued they are exempt from claims because their policies with the district did not cover lead exposure.
Summit Elementary School closed in January because of the lead problem. Students are now taking classes at Broad Street Elementary.
The district solicitor did not provide a comment on the court hearing.
