Father charged in newborn's death kicked out of his own trial

A Wilkinsburg father charged in the death of his 5-week-old daughter was not in court for testimony at his own trial on Tuesday.

A judge threw Lincoln Levys out of court and sent him back to jail after officials said Levys failed to participate properly during the morning proceedings.

This was not the first time Levys was thrown out of court during his own case. Last week, Levys was escorted out of the courtroom when he disrupted jury selection. The judge will give Levys another chance to cooperate during his trial on Wednesday.

Levys, 29, is charged with homicide in the October 2014 death of 5-week-old Sage Levys. According to the criminal complaint, the baby had bruises on her back and arm, plus three broken bones.

Levys was charged separately with abusing his then-20-month-old son with Sheena Alston, as well as her then-7-year-old daughter from a previous relationship.

Tuesday’s testimony was filled with graphic pictures and medical opinions. Children’s Hospital child abuse specialist Dr. Jennifer Wollford examined all three children and told jurors that the “5-week-old victim is a victim of abuse that contributed to her death.”

Levys defense attorney questioned Wollford’s assessment, saying she was not a pathologist and wasn’t present at the autopsy to give an educated cause of death of the baby.

Jurors were also shown photos of the newborn and Wollford testified that “something cut her repeatedly. Something sharp.”

Prosecutors then showed jurors images of Sage’s 20-month-old brother. Wollford told jurors about an injury in the shape of a horseshoe, saying, “There’s no doubt in my medical assessment that’s a burn.”

Levys and Alston were both arrested in October 2014 after the newborn was taken from a home on McNary Boulevard and later died at Children’s Hospital of Pittsburgh. Alston pleaded guilty in November 2015 to three felony counts of endangering the welfare of children in exchange for testifying at Levys' trial.
