MARS, Pa. — A new lawsuit claims there’s more to the death of a local businessman.

Nearly a year later, Donald Miller’s death was ruled a homicide, but no one has been charged.

“Donnie Miller was a 59-year-old brother, father, son and owned a very successful Miller Plastics business and was involved in racing and had a wonderful life, and it was cut short,” said Attorney Wayne Chiurazzi. “We want justice for Donnie. That’s the goal.”

Attorney Wayne Chiurazzi and Attorney Al Lindsay just filed a wrongful death lawsuit on behalf of Donald Miller’s son. On January 21, the Allegheny County Medical Examiner ruled Miller’s death a homicide, nearly a year after his death. So far, no criminal charges have been filed.

“There was a motive to have him killed and the motive was financial,” said Attorney Al Lindsay.

The civil lawsuit claims Miller’s wife benefits significantly from his death versus a divorce. Last year, on March 6, Miller went to a home on Broadstone Road in Adams Township. Chiurazzi and Lindsay say Miller’s wife was there with another man, and according to the complaint, that man strangled Miller and told Adams Township police it was self-defense.

“There’s no dispute that he was strangled into unconsciousness, and then there was no first aid administered to Mr. Miller, nor were EMTS called; they waited to do that.”

After several days in a Pittsburgh hospital, Miller was taken off life support on March 12.

“We only want charges if it’s justified,” said Chiurazzi.

“The reason we’re ultimately pursuing this is because it needs to be exposed,” said Lindsay. “We want the facts to come out, and the chips will fall where they may fall, but we believe there is a value to having people know what happened.”

Channel 11’s Alyssa Raymond spoke with the Assistant Police Chief of Adams Township. He said they’re meeting with the Butler County District Attorney about this case next week and won’t be releasing any information until after that meeting.

Channel 11 also left messages with DA Rich Goldinger and the main listed in the civil lawsuit, but we have not heard back.

Attorney Michael Santicola said his client had no involvement in her husband’s death.
