Trial date set for man accused of hitting, killing 15-year-old on bike in Butler Township

The trial of a man charged with hitting and killing a teenager in Butler County is now set for next month.

Jury selection will start on Nov. 16 in the trial for Joshua Rivera. The trial itself could begin the next day.

This update comes after several legal delays, including repeat judge recusals and arguments over whether the Butler County District Attorney’s Office could prosecute the case.

Rivera is accused of hitting and killing 15-year-old Aiden Lutz in October 2023 as the teen was riding his bike on Dutchtown Road in Butler Township.

Court documents show witnesses heard Rivera yell “I’m sorry” several times before leaving the scene.

Back in August, Rivera’s lawyers argued that charges should be dropped because the case hasn’t made it to trial.

As Channel 11 previously reported, Rule 600 is the right to a fair and speedy trial. Butler County District Attorney Richard Goldinger argues many of the trial delays — like the judge recusals — were out of the Commonwealth’s control.
