PITTSBURGH — A man accused of sexually abusing a girl at his mother's in-home daycare business missed his preliminary hearing Friday because of a lockdown at the Allegheny County Jail.

David Tyus’ mother, Victoria, was in court for her hearing on related charges, however, including endangering the welfare of children.

"She's someone who's elderly. She's never been in trouble before," said her attorney, David Shrager. "She's always been someone who's been an important member of the community and has taken care of children."

In May, Victoria Tyus was charged with endangering the welfare of children and obstruction in child abuse cases when police say she denied David, 18, had access to the children she cared for at her in-home daycare.

"These charges are very upsetting for her," Shrager said. "She adopted this young man, who is accused of these actions, out of the goodness of her heart and tried to raise him, tried to give him a good home."

At Friday's hearing, a judge withdrew the obstruction charge. Shrager said the daycare has been shut down.

"At this point she simply wants to address this and move on with her life," he said.
