McCANDLESS, Pa. — The most serious charge against a school principal accused of exposing himself to young boys inside a gym locker room was dropped Wednesday.
Investigators said Alfonso Deiuliis touched himself inappropriately in front of a 17-year-old boy inside the McKnight Road L.A. Fitness.
In court on Wednesday, a judge dropped several charges against Deiuliis, including the charge of indecent assault of a minor.
Channel 11’s Alan Jennings reported this is significant because if that charge stood, Deiuliis would have been required to register on the Megan’s Law registry.
“The very serious one, indecent assault against a minor, was thrown out for today’s purposes. That’s important because Megan’s Law would kick in if that was held over,” defense attorney Phil DiLucente said.
Jennings reported the judge dismissed the charge because the boy’s story from the sauna talks about Deiuliis tapping him on the leg. To keep the charge, the judge said it would have to be touching.
“It was to get his attention. It wasn’t a massage. It wasn’t a rub and there was no indication whatsoever of any lascivious contact,” DiLucente said.
The teen is the third person to accuse the Brookline principal of this behavior, police said.
A second alleged victim claimed Deiuliis made sexual movements while showing naked. The charge of open lewdness from this claim was thrown out.
“One thing that’s interesting in this particular case it that there is no sexual touching involved. That sexual touching was dropped. This is all he said, she said from a distance,” DiLucente said.
Charges that were held against Deiuliis include misdemeanors, such as harassment.
