FAYETTE COUNTY — The Fayette County District Attorney is recusing himself and his office from prosecuting a case against his son after a car crash last week.
District Attorney Richard Bower released a letter Wednesday, announcing the recusal regarding the involvement of his son, Richard E. Bower Jr., in an Aug. 7 crash on Route 119 in Dunbar Township, Fayette County.
According to the letter, police are investigating the crash as suspected driving under the influence.
“As the District Attorney of Fayette County, I have recused myself and my office from being involved in any investigation and possible prosecution in this matter,” Bower’s letter states. “As a father and as the District Attorney, I do not condone drinking while driving. However, as a father, I believe that this now for me is a personal family matter and I will have no further comment on this case.”
Attorney Samuel Davis has been appointed as a special prosecutor to handle the case.
The younger Bower also works with the Fayette County Bureau of Investigation. According to a letter from County Detective Steve Cooper, which was included with Bower’s release, no disciplinary action will be taken at this time, as Bower Jr. is of legal drinking age, was not operating a county vehicle and he was not working at the time.
“Any future action against Richard Bower Jr. as a result of the unfortunate occurrence will be determined as the investigation continues, but it is my belief, that his future ability to perform his work for the Bureau should not be affected,” Cooper’s letter states.
As of noon on Wednesday, charges have yet to be filed.
