DELMONT, Pa.,None — The manager of a Delmont Walmart store and an attorney representing the retail giant rushed out of district court on Thursday after coming up on the losing end of a lawsuit.
The store lost a civil case filed by consumer advocate, Mary Bach. She said she sued Walmart for misrepresentation and overcharging and this wasn't the first time she's won a lawsuit against them.
"This is the fifth lawsuit that I have now won against this store, this Delmont Walmart for the same problem: practice of putting up a shelf tag that was lower than the price charged at the cash register," said Bach.
On Aug. 26 Bach said she was charged $1 for brown sausage at the register although the price on the shelf said 98 cents.
"All this is for the scanner charge to correlate with the shelf tag or vice versa. I'm not telling them what price to charge for the item they're selling," Bach said.
During Thursday's hearing, Walmart claimed that the mix-up happened because of a change in packaging. The judge disagreed and ruled in Bach's favor and ordered Walmart to pay $100.
Bach said she hopes her efforts will help all consumers.
"Walmart was wrong. They were overcharging customers. Even though it was a minimal amount, they were wrong," said Bach.
Wal-Mart spokesman Greg Rossiter says the company tried to refund the money to Bach, but she refused. He says Wal-Mart respectfully disagrees with the decision, and is considering its options.
