PITTSBURGH — The trial for the men accused of shooting a Clairton police officer is nearing a conclusion.
Emilio Rivera and Marcus Andrejco, charged with a home invasion that led to police
Officer James Kuzak getting shot five times and paralyzed, will soon learn their fate.
The jury has already heard a wiretap conversation of Rivera admitting he shot the officer.
County detectives claim Andrejco was Rivera's sidekick in the crime being in the Miller Avenue house for the home invasion last year.
Andrejco's lawyer, Ralph Karsh told Channel 11’s Alan Jennings his client has a solid alibi.
"Our defense is Mr. Andrejco was not at that residence on the night it was robbed or on the night officer Kuzak was shot. That it was Mr. Rivera and some unknown person," said Karsh.
Karsh criticized the key prosecution witness, calling her testimony confusing.
"She's identified five separate people, and two people for having done the same thing. It may be the worst identification I've ever seen,” said Karsh.
District Attorney Dan Fitzsimmons declined an on camera interview, but spectators in the courtroom remarked that he put on a powerful prosecution, using a victim, and the tape recorded confessions.
