A Detroit, Michigan man is suing the H.J. Heinz Co., claiming the packets were his idea. Both sides will have their day in court Monday.
The lawsuit says David Wawrzynski presented the concept to Heinz in 2008. Heinz officials claim they had the idea first.
Channel 11's news exchange partners at TribLIVE report Wawrzynski is suing Heinz for breach of an implied contract and unjust enrichment.
The case has been in and out of courts in Michigan and Pittsburgh for more than five years.
A Pittsburgh federal jury will decide whether he presented Heinz with "new and novel" ideas that the company used without paying him.
