Allegheny County extends, changes judicial system COVID-19 efforts

PITTSBURGH — The Emergency Operations Order for civil and criminal court proceedings in Allegheny County has been extended through the end of February.

These are some of the changes that go into effect Feb. 1:

  • All proceedings scheduled on or prior to Feb. 26 that cannot be conducted remotely will be postponed until sometime after Feb. 26.
  • All published Civil Division trial lists are still suspended.
  • The CDC’s order temporarily halting certain evictions nationwide has been extended through March 31.
  • All in-person arbitration hearings are suspended through Feb. 26.
  • Indirect Criminal Contempt hearings for people in jail will continue as scheduled for the Family Division.
  • Delinquency Adjudication Hearings for juveniles currently detained and who request an in-person hearing will move forward with in-person hearings.
  • Only non-jury trials and motions which require witness testimony can move forward in person with as many participants appearing virtually as possible.
  • All Court of Common Pleas facilities will stay open to the public and for case filings.

Magisterial District Court operations have been modified:

  • All summary non-traffic/traffic proceedings scheduled from Feb. 1 through Feb. 26 can move forward remotely if all parties agree to do so. If there is no agreement, the proceedings will be postponed to after Feb. 26.
  • Landlord-tenant proceedings based on non-payment of rent or end of lease scheduled from Feb. 1 to Feb. 26 will be postponed. Proceedings based only on breach of lease may move forward as scheduled and in person.
  • Certain civil proceedings will be postponed until after Feb. 26. Civil proceedings in which all parties agree to conduct it remotely can move forward.
  • Preliminary hearings for people not in jail where one of the offenses is felony level may proceed as scheduled with as many participants appearing remotely as possible.
  • Preliminary hearings for people in jail will continue with many appearing remotely.
  • Emergency protection from abuse petitioners will be allowed to appear in person.

There are changes with the Pittsburgh Municipal Court as well:

  • Non-traffic summary proceedings will be postponed.
  • Traffic summary proceedings will be postponed until after Feb. 26.
  • Emergency protection from abuse petitioners may appear in-person.
  • The court will remain open to the public and open for case filings, payments and case processing.
