Two men who police said shot another man in an act of revenge will not be charged with attempted homicide, a judge ruled Thursday. However, prosecutors quickly refiled them.
Daishawn Stikkel, 22, and Nathan Childs, 21, both of Jeannette, are accused of conducting a Greensburg home invasion during which a man was shot multiple times in March 2016. The man survived.
The case took nearly a year for criminal charges to be filed. Thursday, the commonwealth tacked on a conspiracy charge, and the judge held every charge for court except the attempted homicide charge. Prosecutors refiled the attempted homicide charge later in the afternoon.
The shooting victim, Iszac Dallar, was the only one to take the stand on Thursday. Dallar now walks with a limp and told the courtroom that he was in physical therapy for six months after being shot in the hip and knee in his Highland Avenue home.
In January, police charged Childs and Stikkel with attempted homicide and aggravated assault, saying they went after Dallar for allegedly assaulting their relative.
Defense attorney Duke George said, “When he first talked to police, he said he didn’t know who was there, or who shot him.”
Dallar said he was hesitant to come forward because he said, “At the time, I was scared for my daughter’s life and my life, because more harm could have been done.”
Prosecutors said Dallar was given immunity in exchange for his testimony Thursday. However, the defense doesn’t think the commonwealth can prove that Childs and Stikkel showed intent to kill Dallar, which is why they were successful in getting the attempted homicide charges dropped.
The defense said they’re looking forward to their day in court.
"The one and only witness they called today is probably one of the worst witnesses as far as reputation in the community is concerned, as far as credibility and prior criminal conduct is concerned.” George said.
Both suspects will be back in court for a preliminary hearing on Feb. 16.
