Butler man searching for answers after construction project left mess in his backyard

BUTLER, Pa. — A local man is searching for answers after a construction project to deal with flooding issues left a mess in his backyard.

Frank Bayer has lived at the corner of West Penn Street and Miller Avenue in Butler for four years. He says a project to alleviate a flooding problem in the neighborhood has created a new problem.

“My yard is gone,” Bayer said. “I was told originally this would all be underground. This would not affect my property.”

He says he’s lost at least five feet off the end of his yard plus a fence, a tree, some hedges, and his sidewalk. A large, triangular concrete slab and wall sits there instead.

“I’ve contacted the city. I’ve contacted the contractors that are doing this. I’ve contacted the DEP.”

Channel 11 reached out to each of those groups today.

The city’s engineering coordinator told us the state and contractor will have to figure out a plan to fix the yard.

The contractor, Thomas Construction, told us the state and city are in charge of clean-up.

We also learned that the project completion date is October 1.

Bayer called it “more run around.”

“I’ll go as far as I have to. If I have to get a lawyer or somebody to help me with this, I will do that,” Bayer said.

Channel 11 also spoke with a representative from the PA Department of Environmental Protection. We were told they are investigating and hope to have more information for us Tuesday.
